83K Screen Colors Terms of Use
By accessing or using 83K Screen Colors (83k.net), you agree to be bound by these Terms of Use in their entirety. If you do not agree, please discontinue use of 83K immediately.
1. Nature of Service
83K Screen Colors is a browser-based screen color display tool provided as a free, voluntary service. 83K fills your screen with a chosen color, gradient, Kelvin color temperature, or light effect for use in photography, video production, ambient lighting, and related purposes. All color rendering and interface operations within 83K execute locally inside your web browser. The entity responsible for operating 83K is identified in the 83K Impressum.
2. As-Is Provision
83K Screen Colors is provided strictly on an "AS IS", "WHERE IS", and "AS AVAILABLE" basis, with all faults and defects, whether known or unknown, visible or hidden. The entity operating 83K expressly disclaims all representations and warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, completeness, currentness, and freedom from errors, defects, interruptions, or other harmful components.
3. No Warranties
The entity operating 83K does not warrant that 83K will be available on an uninterrupted, timely, secure, or error-free basis, that colors displayed through 83K will be accurate representations of specified color values on your particular display hardware, that Kelvin color temperature presets will match laboratory-calibrated reference standards, that light effects will operate at consistent intervals across all devices, or that any defects in 83K will be identified or corrected. Display color accuracy depends on your monitor hardware, calibration settings, ambient viewing conditions, and browser rendering, all of which fall outside 83K's control.
4. Assumption of Risk
You expressly acknowledge and agree that your use of 83K is entirely at your own risk. You assume full responsibility for all consequences arising from your use of 83K, including reliance on color output for photography, video production, or any other purpose. Moreover, leaving your screen same color for long durations of time may damage it, so we advise you to use the 83K prudently.
5. Photosensitivity and Health Warning
Certain light effects available within 83K, including strobe, flash, and rapid color cycling effects, involve rapidly changing screen brightness and color. These effects may trigger seizures in individuals with photosensitive epilepsy or similar conditions. You are solely responsible for evaluating whether any light effect is appropriate for your circumstances and for the circumstances of anyone present in the viewing environment. The entity operating 83K bears no liability for any health consequences arising from exposure to 83K's light effects.
6. Color Accuracy Disclaimer
83K displays colors based on CSS color specifications processed through your web browser and rendered by your display hardware. Actual color appearance varies by monitor type, panel technology, color profile, calibration state, brightness setting, viewing angle, and ambient lighting conditions. 83K's color output serves as a general-purpose reference. Professional applications requiring certified color accuracy should employ calibrated, hardware-validated display systems.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the entity operating 83K, together with its officers, directors, employees, agents, affiliates, licensors, successors, and assigns, shall bear no liability for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages of any kind, including damages for loss of profits, goodwill, business opportunities, revenue, photographic or video production outcomes, or other tangible or intangible losses, arising out of or in connection with your access to, use of, or inability to use 83K, regardless of the cause of action or theory of liability, whether in contract, tort, negligence, strict liability, or otherwise, and regardless of whether the entity operating 83K has been advised of the possibility of such damages. In jurisdictions where complete exclusion of liability is not permitted, the total aggregate liability of the entity operating 83K for all claims shall not exceed one euro (€1.00).
8. Indemnification
You agree to fully indemnify, defend, and hold harmless the entity operating 83K, together with its officers, directors, employees, agents, affiliates, licensors, successors, and assigns, from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses, including reasonable legal fees, arising out of or in connection with your use of 83K, your violation of these Terms of Use, your violation of any applicable law or regulation, and any reliance on 83K's color output for any purpose.
9. User Responsibilities
You are solely responsible for verifying that any color displayed through 83K meets your requirements before relying on 83K's output for photography, video production, or any other purpose. You are solely responsible for assessing the suitability of any light effect for your environment and for the wellbeing of anyone present. You are solely responsible for ensuring your use of 83K complies with all laws and regulations applicable in your jurisdiction.
10. Intellectual Property
83K Screen Colors, including 83K's name, logos, visual design, source code, color databases, translation databases, and all associated intellectual property, remains the exclusive property of the entity identified in the 83K Impressum. These Terms of Use grant you a limited, non-exclusive, non-transferable, revocable right to use 83K as a screen color display tool in accordance with these Terms of Use. All rights that are not expressly granted are reserved.
11. Service Continuity
The entity operating 83K reserves the right to modify, suspend, limit, or permanently discontinue 83K, in whole or in part, at any time, for any reason or for no reason, with or without prior notice. The entity operating 83K bears no obligation to maintain, support, update, or continue providing 83K.
12. Modification of Terms
The entity operating 83K reserves the right to modify, update, or replace these Terms of Use at any time. Your continued use of 83K following any modification constitutes your acceptance of the modified Terms of Use. You are responsible for reviewing these Terms of Use periodically.
13. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which the entity operating 83K is registered, as identified in the 83K Impressum, without regard to conflict of law provisions.
14. Severability
If any provision of these Terms of Use is found invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
